Terms of Service

1. Acceptance

By creating an account on WhatsThePlan ("WTP"), you agree to these Terms. If you do not agree, do not use the platform.

2. Roles

WTP member: Browse public events and access member codes where available.

Circle Supporter: Apply for selected opportunities and private plans after individual approval. Applying does not guarantee acceptance.

Supporter: Back events you would go to anyway and access the supporter workspace. Rewards — guestlist, access such as backstage, plus-ones — are set and granted by the organizer, stated before you agree to support a night, and unlock on verified results. WTP does not pay supporters and takes nothing from anything a supporter produces. Requires application approval.

Organizer: Publish nights, set the brief and the rewards, review and approve supporters, track results. Organizer accounts are created by WTP on approval of a publication request.

3. Supporter Obligations

  • All promotional content must be clearly marked with #publi or equivalent disclosure as required by Portuguese advertising law.
  • You must not misrepresent your affiliation with events or venues.
  • You must comply with Instagram and other platform terms of service.
  • Imported contacts must have given you prior consent before being added to the platform. Imported contacts are held by WTP and are never shared with organizers.

4. Fees and Commercial Terms

WTP charges organizers only. The commercial terms for each night are agreed directly between the organizer and WTP, in conversation, before the night is published — nothing is quoted automatically by the platform. Once agreed they are locked into the organizer agreement when it is signed and referenced there by a hash. Organizer fees include IVA at the applicable rate. Payment timing depends on Stripe processing and WTP approval workflows.

Nothing is charged on the supporter's side, and WTP does not pay supporters. What a supporter receives comes from the organizer, as stated in the rewards for that night.

5. Organizer Agreement and Non-Circumvention

Before a night goes live, the organizer signs an event agreement with WTP. It records the commercial terms above and a non-circumvention clause: for the period stated in the agreement after a night, the organizer will not engage a supporter introduced through WTP for a night outside the platform on the basis of that introduction, on the fee basis the agreement states. The signed terms are frozen in the agreement and referenced by a hash; a change in terms requires a new agreement.

6. Intellectual Property

WTP owns the platform, brand, and design. Content you upload (promotional posts, proofs) remains yours, but you grant WTP a license to display and use it for the platform.

7. Termination

We may suspend or terminate your account for violation of these Terms. You may delete your account at any time by contacting support@whatstheplan.club.

8. Liability

WTP is provided "as is". We are not liable for lost revenue, missed events, or third-party actions. Maximum liability is limited to the fees you've paid in the prior 12 months.

9. Governing Law

These Terms are governed by Portuguese law. Disputes shall be resolved in the courts of Lisbon.
